Divorce
A divorce is a difficult time. We explain your options clearly and defend your interests and your children's throughout the process.
What it involves
Divorce legally ends a marriage. It can be by mutual consent, when you both agree on the terms, or contested, when there is no agreement and a judge decides. Either way, issues such as child custody, maintenance, use of the family home and division of assets have to be settled.
Is this your case?
- You both want to divorce by agreement and need a well-drafted divorce agreement (convenio regulador).
- Your partner does not want a divorce, or you cannot agree on the terms.
- You married in another country, or one of you is a foreign national.
- You are unsure what will happen with your children, your home or your residence permit.
How we help
We listen to you, explain your options and look for an agreement whenever possible. If there is none, we prepare the claim and defend you in court. If your residence in Spain depends on your marriage, we also review how the divorce affects you. We can help you in Spanish, Arabic, Tamazight, French and English, at our offices in Tenerife, Gran Canaria, Málaga and Barcelona or online, wherever you are in Spain.
We can also help you with child custody and child support.
Frequently asked questions
- What is the difference between a divorce by mutual consent and a contested divorce?
- In a divorce by mutual consent, you both sign an agreement setting out the terms, and the process is usually quicker and cheaper. In a contested divorce there is no agreement and the judge decides.
- Can I get divorced in Spain if I married in another country?
- In many cases, yes, especially if you both live in Spain. It depends on where you live and on your nationalities, so we review it with you.
- Does divorce affect my residence papers?
- It can, if your residence permit depends on your marriage. In that case, we explain the options you have to keep your residence.
