Child support

Children have the right to have both parents contribute to their expenses. We help make sure child support is fair and gets paid.

What it involves

Child support (pensión de alimentos or pensión alimenticia) is the amount one parent pays to cover their children's needs: food, housing, clothing, education and health. It is set in the divorce agreement (convenio regulador) or in the judgment, based on each parent's income and what the children need. Extraordinary expenses, such as medical costs not covered or activities, are separate.

Is this your case?

  • You have separated and the other parent contributes nothing for the children.
  • Your ex has not paid child support for some time, or pays only part of it.
  • You were not married and child support was never set for your child.
  • You cannot agree on who pays for the dentist, glasses or school trips.

How we help

We review each parent's income and expenses to propose a reasonable, well-justified amount. If there is agreement, we put it in writing and take it to court. If child support has already been set and is not being paid, we apply for enforcement and the seizure of the debtor's assets. And if you are being asked to pay an amount you cannot afford, we defend you and look for a realistic solution. We can help you in Spanish, Arabic, Tamazight, French and English, at our offices in Tenerife, Gran Canaria, Málaga and Barcelona or online, wherever you are in Spain.

To recover what is owed, we apply for enforcement of the judgment, and if your income has changed, we apply for a modification of measures.

Frequently asked questions

Until when does child support have to be paid?
It does not end automatically when the child comes of age. In general, it continues while they are still studying or cannot support themselves through no fault of their own. To stop paying it, you need an agreement or a court decision.
What do I do if my ex does not pay child support?
Note down the months that have not been paid and keep the receipts. We can ask the court to enforce the judgment and seize their salary, bank accounts or other assets. The sooner you act, the better.
Can I claim child support if my children's father lives in another country?
Yes, in many cases. There are cooperation mechanisms between countries for claiming and recovering child support. We look at where he lives and which route is best suited to your case.
