Inheritance
Losing a family member is hard enough. We take care of the inheritance paperwork so you can focus on what matters.
What it involves
When someone dies, their assets, rights and debts make up the estate. You need to establish who the heirs are, either through a will or, if there is none, through a declaration of heirs (declaración de herederos). Then comes accepting or renouncing, paying the taxes and dividing the assets. If there is family or property in several countries, it is worth planning carefully.
Is this your case?
- A family member has died and you do not know whether they left a will.
- You and your siblings cannot agree on how to divide the house or the savings.
- You are inheriting a flat in Spain but live abroad, or the deceased had assets in another country.
- You are worried the estate may have more debts than assets.
How we help
We request the necessary certificates, locate the will or handle the declaration of heirs, and draw up the inventory of assets and debts. We prepare the division, coordinate with the notary, the Land Registry and the Tax Agency (Hacienda), and work to help the heirs reach an agreement. If there is none, we defend your rights in court. We can help you in Spanish, Arabic, Tamazight, French and English, at our offices in Tenerife, Gran Canaria, Málaga and Barcelona or online, wherever you are in Spain.
To spare your family these problems, you can prepare your own will, and if you do not have your foreigner identification number yet, we can obtain your NIE.
Frequently asked questions
- What does accepting an inheritance “a beneficio de inventario” mean?
- It is a way of accepting in which you are only liable for the deceased's debts up to the value of what you inherit, not with your own assets. It is useful when you do not know whether there are debts. You can also choose to renounce the inheritance.
- What do I do if another heir is blocking the division?
- First we try to reach an agreement between everyone. If that is not possible, you can ask the court to divide the estate, so that the division does not depend on the will of a single person.
- Do I need an NIE to inherit in Spain if I am a foreign national?
- In general, yes, because you will need it to sign before a notary, register the assets and pay the taxes. If you do not have one yet, we help you apply for it.
