Workplace accidents
After an accident at work, your health comes first. Then we make sure your rights are recognised.
What it involves
A workplace accident is any injury you suffer because of your work, at your workplace or on your way to or from work (accidente in itinere). Some illnesses caused by work can also be treated this way. Getting it classified correctly matters: it affects your sick leave, a possible pension and, if the company did not comply with safety measures, compensation.
Is this your case?
- You have fallen from scaffolding or been injured by a machine on a building site or in a warehouse.
- You have had a road accident on your way to or from work.
- The mutual insurance company (mutua) has treated something that happened to you at work as a common illness.
- The company did not give you protective equipment and you were injured.
How we help
We review how the accident happened, the medical reports and how the mutua has acted. We ask for it to be recognised as a workplace accident if this has not been done, we claim the benefits you are entitled to and, if safety measures were lacking, we assess a surcharge on your benefits (recargo de prestaciones) or compensation from the company. We work with experts when the case requires it. We can help you in Spanish, Arabic, Tamazight, French and English, at our offices in Tenerife, Gran Canaria, Málaga and Barcelona or online, wherever you are in Spain.
If your injuries are lasting, we help you with permanent disability, and if the company neglects safety, we can go to the Labour Inspectorate.
Frequently asked questions
- What is the difference between a workplace accident and a common illness?
- Having it recognised as a workplace accident usually gives you greater protection during your sick leave and for a possible pension. That is why it is important for it to be properly recorded from the start.
- The company doesn't want to report the accident. What should I do?
- Get medical care, explain how it happened and keep evidence: photos, witnesses, messages. You can ask Social Security to decide whether it was a workplace accident, and you can also notify the Labour Inspectorate.
- If I am on sick leave after an accident, does it affect my permit renewal?
- Being on sick leave does not usually make you lose your permit, because in general you remain registered with Social Security while it lasts. Even so, we explain how it fits into your renewal depending on your case.
