Labour inspection

The Labour Inspectorate can force your company to comply with the law. We help you file a clear, well-documented complaint.

What it involves

The Labour and Social Security Inspectorate (Inspección de Trabajo y Seguridad Social) is the public body that makes sure companies comply with employment rules. You can file a complaint with it when your company does not register you with Social Security, does not respect your working hours or puts your safety at risk. After investigating, it can require the company to put things right and impose sanctions on it.

Is this your case?

  • You work without a contract or without being registered with Social Security.
  • Your contract says part-time, but you actually work full-time.
  • You are not allowed to rest between shifts or to record your hours.
  • Safety measures are lacking at your workplace and you are afraid of an accident.

How we help

We listen to you and organise the evidence: timetables, messages, photos and witnesses. We draft a clear complaint so the Inspectorate can act, and we assess whether it is also worth making a claim in court. If you are a company and receive a visit or a request from the Inspectorate, we also advise you on how to respond properly. And if you are a foreign national, we first check how it may affect your papers. We can help you in Spanish, Arabic, Tamazight, French and English, at our offices in Tenerife, Gran Canaria, Málaga and Barcelona or online, wherever you are in Spain.

If you are owed money, we claim it with a wage claim, and if you have not been registered or there are errors in your contributions, we help you with Social Security.

Frequently asked questions

Will my company find out that I have reported it?
The Inspectorate does not reveal who has filed the complaint. Even so, in small companies it can sometimes be guessed, so we work out with you how to do it carefully.
What is the difference between reporting to the Inspectorate and making a claim in court?
The Inspectorate checks whether the company complies with the law, and it can require the company to put things right and fine it. But to get paid what you are owed or to overturn a dismissal, you normally have to go to court. Sometimes it is worth doing both.
Can I report my company if I don't have papers?
You have rights as a worker even if your status is irregular. But first it is worth carefully assessing the steps and how they may affect your immigration situation. We look into it with you in complete confidence.
