Civil liability
If someone has caused you harm, you have the right to have it put right. We help you claim what you are entitled to.
What it involves
Civil liability (responsabilidad civil) is the obligation to make good the harm caused to another person through an accident, carelessness or a breach. It can cover damage to property, injuries, and financial loss or non-material harm. Often the compensation ends up being paid by the insurance company of the person responsible.
Is this your case?
- You had a road traffic accident and the insurer is offering you an amount that seems low.
- You fell in a shop or in the street because of a poorly maintained floor or pavement.
- A leak from the flat upstairs has damaged your home and your furniture.
- A professional did their job badly and caused you financial losses.
How we help
We reconstruct what happened and gather the evidence: photos, witnesses, medical reports, invoices and expert reports. We assess the damage realistically and identify the person responsible and their insurer. First we negotiate fair compensation and, if the offer is not fair, we file the claim and defend it in court. We can help you in Spanish, Arabic, Tamazight, French and English, at our offices in Tenerife, Gran Canaria, Málaga and Barcelona or online, wherever you are in Spain.
If the harm comes from an assault, see our page on assault and injuries, and for other debts, the one on debt claims.
Frequently asked questions
- What is the difference between contractual and non-contractual civil liability?
- Contractual liability arises when someone breaches a contract they had with you. Non-contractual liability arises when there was no prior agreement, for example in an accident. The way to claim and the time limit change, so it is important to identify it correctly.
- Should I accept the insurer's first offer?
- Not without reviewing it first. First offers do not always cover all the damage, such as lasting after-effects or recovery time. We help you assess whether it is reasonable before you sign anything.
- I am a tourist and had an accident in Spain. Can I claim from my own country?
- Yes, in many cases. We can handle the claim in Spain while you stay in your country, communicating online and in your language.
