Assault and injuries

A fight or an assault can end in criminal proceedings. We help you defend your rights and, if you are the victim, claim what you are entitled to.

What it involves

The offence of causing injury (lesiones) punishes causing another person harm to their body or to their physical or mental health. It can arise from a street fight, a road rage argument, an altercation at work or a night out that ends badly. How serious it is depends on the harm caused and how it happened.

Is this your case?

  • You have been attacked and want to report it and claim compensation.
  • You have been reported after a fight in which you were also injured.
  • A doorman or a customer injured you at a bar or nightclub.
  • You have been summoned as a suspect over a push or a blow during an argument.

How we help

We review the medical reports, videos and witness statements to piece together what happened. If you are the victim, we file the complaint, join the proceedings as a prosecuting party (acusación) and claim damages. If you are accused, we look at whether you acted in self-defence or whether there are conflicting versions, and we prepare your defence. We can help you in Spanish, Arabic, Tamazight, French and English, at our offices in Tenerife, Gran Canaria, Málaga and Barcelona or online, wherever you are in Spain.

If the injury was minor, it may be dealt with as a minor offence, and to claim damages outside criminal proceedings we help you with civil liability.

Frequently asked questions

When are injuries a minor offence and when are they a full criminal offence?
It depends mainly on how serious the injury is and on the medical treatment that was needed. If first aid is enough, it is usually treated as a minor offence (delito leve); if further treatment is needed, it is considered a full criminal offence (delito). The medical report is key.
I have been attacked. What should I do first?
Go to a medical centre to be treated and get an injury report (parte de lesiones). Take photos, keep the witnesses' details and make a complaint. Afterwards we help you claim compensation for the injuries and the days you were off sick.
If I am convicted over a fight, could I have problems with my residence?
Yes, it can happen. The conviction creates a criminal record, which can be taken into account when you renew your residence permit or apply for nationality. That is why it is important to defend yourself properly from the start.
