What it involves

Eviction (desahucio) is the court procedure to make whoever occupies a home or premises leave it, usually for non-payment of rent, because the contract has ended or because they have no right at all to be there (precario). It can end with the lanzamiento, that is, the forced removal on the date set by the court.

Is this your case?

  • You are a landlord and your tenant has not paid the rent for some time.
  • You have received a notice from the court and are afraid of losing your home.
  • The contract has ended and the tenant refuses to leave.
  • Someone is living in your property without a contract and without your permission.

How we help

If you are a landlord, we review the contract and the debt, send the formal demand and file the eviction claim together with the claim for the unpaid rent. If you are a tenant, we study your defence, whether in your case paying can stop the process and whether your vulnerable situation can be taken into account. And whenever it makes sense, we negotiate an agreed exit. We can help you in Spanish, Arabic, Tamazight, French and English, at our offices in Tenerife, Gran Canaria, Málaga and Barcelona or online, wherever you are in Spain.

To prevent conflicts, we can help you with the lease contract, and to recover what is owed, with a debt claim.

Frequently asked questions

What is the difference between desahucio and lanzamiento?
The desahucio is the whole eviction court procedure. The lanzamiento is the final moment, when the court officials go to the property so that the owner can recover possession. Before that moment, there may still be room to negotiate.
I have received an eviction claim. What do I do?
Do not ignore it. The deadline to respond is very short and, if you do nothing, the process moves forward without your side of the story. Call us as soon as you receive it so we can study your defence.
If I am evicted, how does it affect my renewal or my arraigo?
Losing your home can complicate procedures that require padrón registration or a stable address. If you have an immigration application in progress, we help you update your address so that the change does not harm you.
