Banking claims
Up against a bank, it is easy to feel small. We review your contracts and help you claim back what you have been overcharged.
What it involves
Banking claims are used to recover what the bank has charged you improperly or to cancel the effect of unfair terms. They concern mortgages, personal loans, credit cards and accounts. They usually start with a complaint to the bank's customer service department and, if the answer is not satisfactory, they can end up in court.
Is this your case?
- Your mortgage has a floor clause (cláusula suelo) or you were made to pay all the costs of setting it up.
- You have a revolving credit card and the debt does not go down even though you pay every month.
- The bank charges you overdraft or account maintenance fees you do not understand.
- You were sold a complex financial product without its risks being explained to you.
How we help
We review your contracts, statements and receipts to identify what can be claimed and what amounts are at stake. We prepare the complaint to the bank and, if the answer is not enough, we assess with you whether it is worth going to court. Before each step, we explain the costs and your real chances. We can help you in Spanish, Arabic, Tamazight, French and English, at our offices in Tenerife, Gran Canaria, Málaga and Barcelona or online, wherever you are in Spain.
If it is the bank that is claiming against you, we defend you in the enforcement proceedings, and if you are about to sign a loan, we review your contracts first.
Frequently asked questions
- What is a revolving credit card and why can I make a claim?
- It is a card where you pay an instalment that barely reduces the debt, because almost all of it goes on interest. If the interest is very high or you were not clearly informed, in many cases you can make a claim.
- Do I have to complain to the bank first before going to court?
- In most cases it is advisable, and sometimes it is required. A well-prepared prior complaint can solve the problem or leave a record for the court case. We help you draft it.
- The bank has blocked my account or won't let me open one because I am a foreign national. What do I do?
- Ask in writing for the reason for the block or the refusal. Sometimes they ask for additional documents, such as your NIE or proof of income. If the answer is not justified, we help you make a claim.
